The present General Terms and Conditions as described here apply to every product offered on the website www.barbecook.com and all deliveries. Every order implies acceptance of these general terms and conditions. The General Terms and Conditions of LivWise are exclusively governed by Belgian law. You have the right to inform LivWise that you are cancelling the purchase, without payment of a fine and without giving any reason. This must be done within 14 calendar days from the day following the delivery of the product.

A purchase through the website www.barbecook.com includes all BBQs and related items, barbecue accessories and parts for barbecue equipment.

LivWise is a member of BeCommerce vzw and subscribes to the BeCommerce Code of Conduct. BeCommerce aims to increase consumer confidence in online and offline distance sales (through catalogs, internet websites, television, direct mail, telephone, SMS and other media). This is done with support of the BeCommerce quality label, which guarantees the consumer that the company using the label complies to a number of rules and is regularly verified for this.

Article 1: Purchase and Payment

The agreement between LivWise and you as the purchaser is concluded if you have accepted and met with the conditions of LivWise. The lack of an ordinary signature does not affect the binding force of the offer and its acceptance.

LivWise reserves the right to refuse an order or to subject it to additional conditions such as large orders, orders by minors, incomplete order procedures or problems with previous orders.

LivWise always confirms the purchase by email. If no confirmation email has been sent, the agreement is not binding. The confirmation will be sent to the email address that you have provided us.

LivWise remains the owner of all products until full payment of all amounts owed from the agreement, regardless of whether delivery has already taken place.

We use an external payment partner Mollie for the payment of products purchased from LivWise. We accept the following payment methods:

  • KBC / CBC Payment Button 
  • Belfius Direct Net
  • SOFORT Banking 
  • iDEAL 

LivWise may expand the payment methods in the future. Expansion of payment methods will be announced through the website.

To ensure a secure online payment and the security of your personal data, the transaction data is encrypted with SSL technology. You do not need any special software to pay with SSL. We also guarantee this security by engaging specialised parties such as recognised credit card issuers and payment partners.

In the event of late payment, LivWise is authorized to terminate the agreement with immediate effect or to suspend (further) delivery until the moment that you have complied with the payment obligations.

The General Terms and Conditions and the confirmation emails are always drawn up in the language of the website.

Article 2: Delivery and delivery period

The delivery time stated by LivWise is approximate and does not have a strict deadline.

The final delivery period is 30 days after receipt of the order, with the exception of payment by bank transfer, where the final delivery period is 30 days after receipt of payment.

If you have ordered a product that is temporarily out of stock, it will be indicated in case the product is available again.

As soon as the products are delivered to the specified address, the risk of the products is transferred to the purchaser.

Different conditions may apply to deliveries abroad.

LivWise delivers to the following countries: Belgium, Bulgaria, Croatia, Cyprus, Denmark, Germany, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Austria, Poland, Portugal, Romania, Slovenia, Slovakia, Spain, Czech Republic, United Kingdom and Sweden.

Delivery takes place exclusively by courier service unless agreed otherwise prior to the agreement. Contact details of the courier service can be found on the following website: www.dpd.com.

The delivery or shipping costs will be communicated to you before confirming your purchase. If the shipping costs cannot be calculated automatically, this will be stated and / or an indication of the shipping costs will be provided.

Article 3: Product

Information, images, oral communications, statements, etc. with regard to all offers and the most important characteristics of the products that are provided through telephone or by email are displayed or made as accurately as possible. LivWise is not liable for advice it provides, printing and typing errors on the website or technical data provided by suppliers or manufacturers.

Availability is indicated for each product. LivWise makes every effort to correctly communicate this information, yet it may happen that an impossibility to deliver occurs. This can be due to incorrect stock data or products that are no longer available from the suppliers. In this case LivWise will notify you as soon as possible and propose a solution.

The products offered by LivWise comply with legal standards and may be sold online.

It is possible that LivWise includes links on its website to other websites that may be interesting or informative for the visitor. Such links are for informational purposes only. LivWise is not responsible for the content of the website referred to or the use thereof.

Article 4: Refund period (trial period) and Returns

As a consumer you have a right of withdrawal for all products purchased from LivWise, in accordance with Article VI.47 Code of economic law. Based on the right of withdrawal, the consumer can still cancel the purchase within fourteen (14) calendar days from the day following the delivery of the product. The consumer is not obliged to pay a compensation or give any reason. LivWise would of course like to hear your feedback in order to improve our services.

During the refund period, LivWise expects you to handle the products and packaging with the utmost care.

If you wish to exercise your right of withdrawal, you must inform us in writing and in an unambiguous manner within the 14 calendar days from the day following the delivery of the product by sending an email to support@barbecook.com. You can use the standard form for the right of withdrawal. The consumer must completely and truthfully fill in this form. There is no penalty for canceling the purchase and this is possible without giving any reason.

The consumer must return the products to LivWise as soon as he has announced that he wishes to exercise his right of withdrawal, and no later than fourteen (14) calendar days after this announcement. We recommend that you keep proof of shipping in case of any dispute. In any case, the consumer bears all costs and risks of return.

The costs for returning the products will be covered by the consumer in case of withdrawal, if the goods cannot be returned by ordinary mail due to their nature.

In addition, the consumer is liable for the depreciation of the products resulting from the handling of the products that goes beyond what is necessary to determine the nature, characteristics and functioning of the products. LivWise is entitled to charge the costs of the depreciation in proportion to the reimbursement. However, this can only be done after LivWise has refunded the initial purchase amount to the consumer.

LivWise will refund the full purchase amount excluding shipping costs within 14 days of receipt of the products. LivWise reimburses the consumer with the same payment method as used for the original transaction, unless the consumer has explicitly agreed otherwise. In any case, no costs will be charged for the reimbursement.

If the consumer does not meet the above conditions, there is an unlawful use of the right of withdrawal. In that case, the products will be returned to the consumer, at the consumer's own expense and risk. LivWise undertakes to clearly communicate its motives to the consumer.

Exceptions to the stipulated provisions are the following:

If a product has been specially made or changed for you, you have no right of withdrawal.  

Article 5: Warranty conditions

Products sold by LivWise enjoy a two-year warranty on all manufacturing defects, from the date of purchase and to the extent that the use is in accordance with the instructions for use. The receipt or invoice stating the date of purchase is the warranty certificate. This warranty is limited to the repair or replacement of parts that show defects during normal use.

If products contain an expiration date, the warranty will run until the end of this expiration date, with a maximum of 2 years.

Warranty handling will be carried by LivWise including the shipping costs incurred by you to return the product to us.

Article 6: Defects

You are obliged to carefully inspect the products or have them inspected immediately upon receipt. You must check whether the delivered products comply with the agreement:

  • Were the correct products delivered?
  • Do the delivered products meet the agreed quality requirements or - if these are not available - the requirements that may be set for normal use?

If you discover a defect or shortcoming, you must report this within 2 months of discovery preferably in writing by sending an email to support@barbecook.com.

The costs for returning products that do not comply with the description of the offer are at the expense of LivWise.

Article 7: Force majeure

Force majeure includes all external causes, foreseen or unforeseen, on which LivWise has no influence, but as a result of which LivWise is unable to fulfill its obligations. Hereunder we understand, among other things, without being exhaustive: strikes, fire, business disruption, ...

LivWise also has the right to invoke force majeure if the circumstance that prevents (further) fulfillment occurs after LivWise should have fulfilled its obligation.

During force majeure, the delivery and other obligations of LivWise are suspended. If the period, in which compliance with the obligations by LivWise is not possible due to force majeure, lasts longer than 8 weeks, both parties are authorized to dissolve the agreement, without there being an obligation to pay compensation in that case.

Article 8: Prices

Before payment you will be informed of the prices of the products. All prices are expressed in EUR and include VAT, Recupel, BEBAT and Reprobel. The purchaser is obliged to pay the price that LivWise has communicated in its confirmation. Obvious errors in the price, such as obvious inaccuracies, can also be corrected by LivWise after the conclusion of the agreement. Complaints about the price (setting) must be clearly communicated in writing within seven (7) calendar days. Lodging a complaint does not result in suspension of payment.

LivWise has the right to change prices at any time. If the price change is the result of changes in the VAT rates, this will be charged to the customer.

Offers are valid while stock lasts.

If a price increase occurs after the conclusion of the agreement, you can dissolve the agreement regardless of the percentage of the increase.

A personalised offer is valid for 2 weeks, unless a different period is stated in the offer.

Article 9: Intellectual property rights

All intellectual property rights and derivative rights concerning the products and trade names belong to LivWise. These intellectual property rights include copyrights, trademarks, design rights and / or other (intellectual property) rights, including patentable or non-patentable technical and / or commercial know-how, methods and concepts. It is prohibited to use and / or make changes to the intellectual property rights as described in this article, unless it is for private use of the product itself.

Article 10: Protection of your personal data

The information you provide is necessary for the processing and completion of the orders, and the set-up of the accounts and contracts. If this information is missing, the order will inevitably be cancelled. Providing incorrect or false personal data is considered a violation of the current General Terms and Conditions. Your personal data will only be processed in accordance with the privacy policy that can be consulted through our Website and the relevant legislation.

Article 11: Questions and complaints

Complaints or disputes can be reported by e-mail to support@barbecook.com and will be dealt within a reasonable period of 7 working days. In case the complaint is found to be well-founded, our liability is limited to the exchange of the products. Any liability of LivWise is limited to the amount actually paid for the order.

Article 12: Disputes

All offers and agreements are exclusively governed by Belgian law and the courts of the district East-Flanders (Ghent) are competent.

If a dispute arising from offers or agreements that you have concluded with LivWise is not resolved, you can appeal to the Consumer Mediation Service (http://www.consumentenombudsdienst.be). You can also submit a complaint to the Online Dispute Resolution of the European Union (http://ec.europa.eu/odr/).

If a dispute arising from offers or agreements that you have concluded with LivWise is not resolved, it will be submitted to the competent court in Kortrijk, Belgium, unless a mandatory legal provision explicitly designates another court as competent.

The information on the website is of a general nature. The information is not adapted to personal or specific circumstances and can therefore not be considered as personal, professional or legal advice to the visitor.

LivWise makes every effort to ensure that the information provided is complete, correct, accurate and updated. Despite these efforts, inaccuracies may occur in the information provided.
